Executive Summary

Board authorization is needed under Revenue & Tax Code (R&T), § 4675 to approve disbursement of excess proceeds. Appropriate research and required legal notifications has been completed on these parcels.

 

Background

On December 2, 2016, the Santa Cruz County Tax Collector conducted a public auction to sell certain parcels which were delinquent in paying property taxes for five or more years. After payment of taxes and allowable expenses due on the respective parcels, a notice of any excess proceeds was published within the timeframe prescribed in the R & T Code and parties of interest were individually notified of the process to claim any excess funds through certified mail. Funds were placed in a trust fund and a one year mandatory waiting period on all claims began on the date of recordation of successful bid.

 

Seven (7) properties were offered at auction and 7 parcels sold resulting in $18,851.24 in excess proceeds.

 

R & T Code, § 4675 establishes the priority in which proceeds are to be paid to any claimants. The attached spreadsheet (Exhibit A) details the distribution of the excess proceeds from the December 2, 2016, sale. All required statutory publications and notifications have been completed. The payment of excess proceeds to the claimants will be paid 90 days following your Board’s approval. The code provides this time period to allow for any action or proceeding of the decision of the Board of Supervisors.
