Recommended Action(s):

1.              Consider the creation of a new zone of benefit, Blue Mountain Ridge (Zone BMR), within the current boundary lines of County Service Area No. 23, Old Ranch Road (CSA 23);

 

2.              Open a public hearing to hear testimony, objections or protests, if any, to the creation of the new zone;

 

3.              Close the public hearing;

 

4.              Adopt the attached resolution to create Zone BMR, within CSA 23.

 

Executive Summary

Board of Supervisor approval is sought for the creation of a new zone of benefit, Blue Mountain Ridge, within the current boundary lines of CSA 23, Old Ranch Road. The approval process includes a public hearing and adoption of a resolution establishing the new zone.

 

 

Background

California Government Code Section 25217 governs the creation of zones of benefit within county service areas. At the request of property owners, on January 9, 2018, the Board adopted a Resolution of Intention to modify the boundaries and create a new zone of benefit, Zone BMR, within CSA No. 23 and set today as the public hearing date on the matter.

 

 

Analysis

Section 25217 requirements include that the Board hold a public hearing prior to the adoption of a resolution establishing the new zone. The new zone will consist of four properties and any fees collected will be utilized solely for the operation and maintenance of Blue Mountain Ridge. Following creation of the new zone, a separate public hearing setting a benefit assessment rate for Zone BMR is scheduled on today’s agenda.
