Financial Impact

The Cannabis Licensing Program, including enforcement activities, is intended to be supported through licensing fees. A complete analysis of potential fees will be presented to the Board in the Supplemental Budget.

Recommended Action(s):

 

1)              Adopt Resolution making California Environmental Quality Act (CEQA) and Coastal Act Findings and amending the County's General Plan and Local Coastal Program to regulate commercial cannabis cultivation, manufacturing and distribution activities for non-retail commercial cannabis businesses;

 

2)              Adopt Ordinance amending Chapters 13.10 and 16.01 of the Santa Cruz County Code, including making CEQA findings (approved in concept April 24, 2018);

 

3)              Adopt Ordinance amending Chapter 7.128 of the Santa Cruz County Code, including making CEQA findings (approved in concept April 24, 2018);

 

4)              Adopt Resolution approving language of Non-Retail Commercial Cannabis Business Best Management and Operation Practices (BMOP) requirements including making CEQA findings; and,

 

5)              Direct staff to file CEQA Notice of Exemption relating to the above actions.

 

Executive Summary

Approval of the recommended actions will allow staff to implement a Cannabis Licensing and Land Use Regulatory Program to regulate commercial cannabis cultivation, manufacturing and distribution activities.   

 

Background

On April 24, 2018 the Board held a public hearing to consider and adopted in concept the proposed ordinances to amend Chapters 7.128, 13.10 and 16.01 of the Santa Cruz County Code and proposed amendments to the General Plan/Local Coastal Program to regulate commercial cannabis cultivation, manufacturing and distribution activities. 

On April 24th the Board asked staff to amend the proposed Best Management and Operational Practices (BMOP) requirements to incorporate language requested from the City of Santa Cruz regarding the sale of bulk water.  The revised language has been incorporated into Section D(7)(c).

 

Analysis

The recommended actions are part of programmatic efforts to regulate cannabis business activity within the unincorporated County.
